Texas Privacy Rights Notice

This Privacy Notice for Texas Residents ("Notice") supplements the information contained in the Privacy Policy of International Risk Management Institute, Inc. and its subsidiaries and affiliates (collectively, "IRMI," "we," "us," or "our") and does not apply to individuals who are Texas residents acting in a commercial or employment context (each, a "consumer" or "you").

The Texas Data Privacy and Security Act (the "TDPSA") defines "personal data" broadly as any information that is linked or reasonably linkable to an identified or identifiable individual. However, the TDPSA definition of "personal data" does not include deidentified data or publicly available information. This Notice uses the TDPSA definition for personal data. "Personal data" as used in this Notice has the same meaning as "personal information" as used in our Privacy Policy.

Categories of Personal Data We Process and Purpose for Processing

Categories of Personal Data We Can Share with Categories of Third Parties

Except as otherwise expressly provided in this Notice, we can share any of the categories of personal data listed in "What Information Do We Collect and How Do We Collect It?," "Cookies and Other Technologies; Do Not Track," "How We Can Use the Information We Collect," and "To Whom Do We Disclose Your Information?" in our Privacy Policy with the categories of third parties as described in "What Information Do We Collect and How Do We Collect It?," "Cookies and Other Technologies; Do Not Track," "How We Can Use the Information We Collect," and "To Whom Do We Disclose Your Information?" in our Privacy Policy.

Consumer Rights

You have the right, at any time, to request the following.

  • Confirmation of whether we are processing your personal data and to access such personal data
  • Correction of inaccuracies in your personal data, taking into account the nature of the personal data and the purposes of the processing of your personal data
  • Deletion of personal data provided by or obtained about you
  • If the data is available in a digital format, to obtain a copy of your personal data that you previously provided to us in a portable and, to the extent technically feasible, readily usable format that allows you to transmit the data to another controller as defined under the TDPSA without hindrance

You also have the right, at any time, to request to opt out of the processing of the personal data for any of the following purposes (each, a "right to opt out"):

  • targeted advertising,
  • the sale of personal data, and/or
  • profiling in furtherance of a decision that produces a legal or similarly significant effect concerning you.

At this time, since we do not engage in the processing of personal data for any of the foregoing purposes, we do not offer such right to opt out.

Finally, you have the right to not be discriminated against for exercising any of the consumer rights contained in the TDPSA.

Consumer Requests

To exercise your rights as described above, please submit a consumer request to us via Contact Us or via toll-free telephone at (800) 827–4242.

A consumer request must:

  • Provide sufficient information that allows us to authenticate your identity as more particularly described in this Notice.
  • Specify the consumer rights you wish to exercise with sufficient detail that allows us to properly understand, evaluate, and respond to it.

We will provide information in response to a consumer request up to twice annually per consumer.

We may not be able to comply with a consumer request if we are unable to authenticate the consumer request using commercially reasonable efforts. In such event, we may request that the consumer provide additional information reasonably necessary to authenticate the consumer and the consumer request.

We endeavor to respond to consumer requests within forty-five (45) days of the date of receipt. If we require more time when reasonably necessary, taking into account the complexity and number of the consumer requests (up to an additional forty-five (45) days), we will inform you of, and the reason for, such extension.

If we decline to take action regarding a consumer request, we will inform you within forty-five (45) days of the date of receipt and the response will also describe the justification for declining to take action and provide instructions on how to appeal the decision.

If the data is available in a digital format, for a consumer request to obtain a copy of your personal data that you previously provided to us, we will select a format to provide your personal data in a portable and, to the extent technically feasible, readily usable format that allows you to transmit the data to another controller as defined in the TDPSA without hindrance, including by email.

We do not charge a fee for information provided in response to a consumer request unless requests from a consumer are manifestly unfounded, excessive, or repetitive.

Appeals

You may appeal our decision declining to take action regarding your consumer request by submitting an appeal to us via Contact Us or via toll-free telephone at (800) 827–4242.

Within sixty (60) days of the date of receipt of such appeal, we will inform you in writing of any action taken or not taken in response to such appeal, including a written explanation of the reason(s) for the decision. If you are not satisfied with our response, you may contact the Texas Attorney General by clicking [https://oag.my.salesforce-sites.com/CPDOnlineForm] or by calling its Consumer Protection Hotline at (800) 621–0508.

We will deliver our written response via mail or via email, at your option.
