New MCS-90 Book Explains and Solves Hidden Exposures

Dallas, TX, August 18, 2004—The MCS-90 endorsement is a highly misunderstood and increasingly litigated one-page insurance endorsement required by the Motor Carrier Act of 1980 to be attached to policies covering auto liability exposures of certain types of businesses, such as motor carriers. Its purpose is to certify that the insured maintains a minimum level of financial responsibility for compensating others involved in truck accidents that result in bodily injury, property damage, or environmental damage. This new IRMI publication, The MCS-90 Book: Truckers versus Insurers and the Government Makes Three, uncovers many potential pitfalls, coverage traps, underwriting concerns, and claims issues lying under the surface of this endorsement. For example, it explains why attaching the MCS-90 endorsement to a policy may give the insurer a license to sue the insured after paying a loss and what to do to avoid it, why insurers need to underwrite the financial risks as well as the liability risks of trucker insureds, and what claims supervisors should consider when handling claims that come within the coverage purview of the endorsement. Anyone who buys, sells, or underwrites insurance for motor carriers or adjusts trucking insurance claims will benefit from this book.

This new IRMI book was a research project of the Consulting, Litigation, & Expert Witness (CLEW) Section of the CPCU Society headed up by Gregory G. Deimling, CPCU, ARM, AMIM, principal of Gregory G. Deimling and Associates and also a principal of Globe Insurance Agency, Inc.; George M. Gottheimer Jr., Ph.D., CPCU, CLU, ARe, president and CEO of Kernan Associates, Inc.; Donald S.
